On approximately 7/1/2024, I sought out a contractor to upgrade our swamp cooler to refrigerated air and upgrade our heating system. We did some research and gathered quotes from several contractors, but ultimately chose to go with MGP Mechanical located in Albuquerque, NM.

I had located MGP through PNM's Registered Cooling Program partner list. I had also done extensive research to verify the company's reputation which all seemed great. Mr. Gerald Peralta, the owner, was the person who came out to our home to do an assessment of our current system and offer quotes to upgrade the system. Mr. Peralta offered 3 different quotes for differing tiers of energy efficiency ranging from low to high. Three quotes were provided with the lowest tier priced at ~$13k, the medium tier at ~$15k, and the highest efficiency being offered at $16.5k.

Mr. Peralta explained to me that if I were to purchase the highest dollar/most energy efficient system, I would then, in turn, become eligible for all the rebates and incentives out there. There were a few rebates and incentives that Mr. Peralta knew of off the bat, but he mentioned that it was up to me to seek out the rebates on my own as he was unsure of everything that was out there and couldn't offer any specifics on amounts. He did have a light understanding of the federal incentives, but mentioned I would have to seek out a CPA to learn the exact amounts based on my income. Luckily, I happen to be a CPA, so I mentioned this to him. Even though he wasn't familiar with more than a few of the rebates, he did assure me that the highest priced/highest efficiency system would at least check the box to be eligible for any rebate out there. This assurance was made verbally and is also loosely on the quotes he provided. I relied upon his statement of this system being eligible for any tax/incentive out there.

I went ahead and chose MGP over several other contractors, even though they were not the cheapest option. Mr. Peralta's assurance that this system would qualify for all available rebates and incentives was the deciding factor. I knew that even though the system was ~$16.5k, I would be getting some assistance in the form of money back through rebates and tax deductions that would help offset the cost. I am a married father of 3 young child and have not been immune from the ever-rising cost to live. A ~$16.5k heating and cooling system is a BIG deal to me financially.

MGP were true professionals in their installation service and quickly completed the instal to what I believe is a very high standard. The issues began when I started seeking out and applying for the rebates. I quickly came to learn that the system Mr. Peralta represented to me as ""checking the box to qualify"" for all the rebates and incentives was not qualifying for anything I sought out. Even the rebates Mr. Peralta knew of and noted on the invoice recently got denied. To date the following are rebates and amounts that I've been declined for due to Mr. Peralta's fraudulent represetation of facts regarding the energy efficiency of the system.

York Manufacturer Rebate: $275
York Manufacturer Rebate: $150
NM Energy Minerals & Natural Resources Department Rebate: $1,000
PNM Heat Pump Rebate: $400

I was also shocked that with MGP being part of PNMs Registered Cooling Parter program that he didn't advise me to get a home energy check up prior to the install. This along with the false statement of facts regarding efficiency, caused me to be ineligible for the PNM rebate above.

Once I found out about these rebates gettin denied, I immediately emailed MGP asking that they replace the system they installed with one which will qualify at their cost (it was their fault and should do this free of charge). The second remedy I proposed was for them to refund the amounts I was denied for. I have not heard back from that email I sent on 8/12/24. They are also not answering another request I sent for a manufacturers certificate.

Don not trust these guys. He is quick to take your money. A true snake oil salesman with zero integrity.

To Gerald and MGP, you may dodge, lie, and deflect, but God sees all and you will be held accountable at some point. I pray for you.
