Actually, he was a friend and a one time a very good plumber. Not sure what's going on, but recently had him do a job where he ""completed "" the job only to find out that he never hooked the lines to the kitchen into the system, didn't put in shut offs and many other things. Wish I had better news

Response/update to complaint:

The respondents master plans, which were drawn out on a old box and left for
me were fine. He is the contractor and he evaluated the jobsite and he
should have known where and how the holes, the duct work, the heating units,
and generally how the balance of this job should be completed. Based upon
that he provided an estimate, then a contract, and agreed to do the job.
There was never any delay that took weeks on my end. The respondent wanted
the job because he was very slow at that time and he clearly informed me that
he was ready willing and able to complete this job.
As soon as the respondent received my deposit check, he suddenly became very
busy and hard to reach. Perhaps because the season was turning cold, but
what ever the reason, he accepted my deposit and agreed to complete this job
for an agreed upon fee.
Since the respondent has been in business for so long and I expect has
entered into many contracts, I would suspect that he should understand his
own contract.
""The price to install 2 york fired hot air furnaces one being 100000 btu and
the other 60000 btu furnace. In main area of woodford mall $7000.00 ""
this is his contract for labor and materials to complete the job.
He also sent a text (which I already provided to you) indicating that he had
already ordered the 2 heating units, which cost approximately $
3500.00/4000.00.
He was indicating that he should have already received the heating units that
he ordered (presumably with the money that I gave him). They were never
provided or otherwise delivered to me. If in fact the respondent ordered
them, then he must still have them. Regardless, I know that I never received
them.
Also in this case the respondent merely supplied about 25% of the materials
to perform the duct work at the location. That means he merely delivered
those materials and from that, he installed only about 5 %. I previously
sent pictures showing the uninstalled supplies laying at the location.
The respondent agreed to the job parts and labor and that is what i paid for.
However, he only supplied about 25% of the materials, installed on 5% of
that, cuts some holes, and did not provide the $3,500 heaters. Since the
heaters were not supplied, he obviously did not do the labor to install them.
He did not even do the labor to complete the installation of the 25% of the
duct work, much less complete the labor for installation of all the duct
work. Respondent represents that he has time records, but does not make any
effort to supply them. I would think that he should produce those. However,
regardless, there is a basic problem with his position which belies the
accuracy of his claimed defense. That is that if the total job costs
approximately $7,000, and the heaters which he never supplied to me cost
approximately $3,500, then the total labor to do this job could only be a
total of $3,500 AND, that is not including the cost of the duct work supplies
etc.
In other words, the max amount of labor could cost is $3,500 and in reality
it has to be less because of other supply costs. However respondent is
essentially claiming that he is entitled to keep essentially all of the
approximately $7,000 I paid him without even delivering the heaters.
It was always hard to contact respondent to get an update on the status of
this project..
When i did reach him by calling from a diff phone # he would promise me
multiple times that it would be done real soon. I even have this in text from
him.
As a result, I have had 2 companies come in for estimates on the same job.
Both companies had said that the way respondent was doing the job, the
heaters would not have worked properly.
They both said the units and duct work need to be in the rooms and not the
attic.
I also had someone come in to price the repair of the ceilings as a result
of the numerous holes the respondent cut. These holes are now a damage to my
property caused by the respondent. This cost is $8300.00. This was emailed
to you earlier.
Accordingly, a proper refund was not provided. In addition, it is obvious
just by looking at the economics of his claim that he should keep
approximately 98% of the money when not even half of the total paid for
supplies (the heaters) was provided, is blatantly telling about how specious
his purported rationale is. I would suggest this type of conduct is much
more indicative of a deceptive and misleading practice in an attempt to
unfairly keep the money tendered without doing the agreed upon work.
